These General Terms and Conditions govern the contractual relationship between the organiser and the participants of the World FunDrinks Award (WFA).
The technical and professional rules of the competition – in particular product groups, categories, submission requirements, evaluation system, jury, awards and classifications – are governed by the current World FunDrinks Award Rules & Regulations.

1.2 These General Terms and Conditions apply to all registrations and bookings for participation in the World FunDrinks Award and to all services directly related thereto provided by the organiser.
1.3 Participants may include, in particular, producers, brand owners, bottlers, importers, distributors, retailers or other natural or legal persons authorised to submit the respective products.
1.4 In addition to these GTC, the current World FunDrinks Award Rules & Regulations and the applicable trademark and licensing provisions shall apply.
2. Registration and Conclusion of Contract
2.1 The presentation of the World FunDrinks Award and its services on the website does not constitute a binding contractual offer by the organiser.
2.2 By completing the electronic registration or booking process, the participant submits a binding offer to participate in the World FunDrinks Award.
2.3 The organiser may accept this offer, in particular, by issuing a written or electronic confirmation of participation, by sending an invoice or by requesting payment.
2.4 Participation is only finally confirmed once the applicable participation fees have been paid in full and all relevant participation requirements have been fulfilled.
2.5 The organiser reserves the right to reject registrations or individual products if they do not comply with the participation requirements, product definitions or categories of the World FunDrinks Award.
2.6 Registration, invoicing and communication are generally carried out electronically. The participant is responsible for providing a valid email address and ensuring receipt of electronic communications.
3. Participation and Products
3.1 Products may be submitted if they comply with the categories announced for the respective World FunDrinks Award.
3.2 The World FunDrinks Award is particularly dedicated to the international world of modern alcohol-free and reduced-alcohol beverages, 0.0 products, No- and Low-Alcohol products, dealcoholised beverages, alcohol-free alternatives and innovative beverage concepts.
3.3 The eligible product groups, categories, subcategories and definitions are published in the current World FunDrinks Award Rules & Regulations.
3.4 The participant is responsible for ensuring that the submitted products, as well as their production, labelling and marketing, comply with all applicable legal requirements.
3.5 The organiser is entitled to assign a product to another category or subcategory if this is necessary to ensure a professionally correct and comparable evaluation.
4. Prices and Payment Terms
4.1 The participation fees and prices published at the time of registration or booking shall apply.
4.2 The amount of the participation fee may depend, in particular, on the number of products submitted, the date of registration and any additional services booked.
4.3 Prices are stated inclusive or exclusive of VAT in accordance with the applicable tax regulations.
4.4 For participants from other EU Member States or third countries, the applicable VAT regulations shall apply.
4.5 Where a valid VAT identification number is required for the applicable VAT treatment, the participant must provide this number correctly and in full.
4.6 Invoices must be paid in full, without deduction, within the payment period stated on the respective invoice.
4.7 Bank charges, transfer fees, exchange-rate costs and other costs associated with payment shall be borne by the participant, unless such costs were caused by the organiser.
5. Product Samples and Shipping
5.1 Product samples required for evaluation must be sent to the specified delivery address within the deadlines set by the organiser and in the required quantity.
5.2 The specific requirements regarding the number, quantity, packaging, labelling and shipping of samples are set out in the World FunDrinks Award Rules & Regulations and/or the participation information.
5.3 All costs relating to shipping, transport, insurance, customs clearance, importation and other charges shall generally be borne by the participant.
5.4 For international shipments, the participant is responsible for correct declaration and for providing all required shipping, customs and accompanying documentation.
5.5 Product samples that are not received or are received after the applicable deadline may be excluded from the evaluation.
5.6 In the event of late or failed delivery, there is generally no entitlement to a refund of the participation fee unless the organiser is responsible for the late or failed delivery.
5.7 Submitted product samples will generally not be returned.
6. Conduct of the Competition and Evaluation
6.1 The professional conduct of the competition is governed by the current World FunDrinks Award Rules & Regulations.
6.2 Submitted products are evaluated by a jury selected and appropriately trained by the organiser.
6.3 The evaluation is based on the evaluation system established for the World FunDrinks Award.
6.4 The evaluation constitutes a professional sensory assessment of the respective product at the time of tasting.
6.5 There is no entitlement to a specific score, medal, award, classification, ranking or the title “Best in Class.”
6.6 The decisions of the jury are final. Legal recourse regarding professional and sensory evaluations is excluded to the extent permitted by law.
7. Results, Awards and Classifications
7.1 Scores, medals, awards, titles, Best in Class awards and producer classifications are granted exclusively in accordance with the current World FunDrinks Award Rules & Regulations.
7.2 The organiser is entitled to publish the competition results as well as the names of participating and/or award-winning products, brands and producers.
7.3 The use of medals, logos, awards, word and figurative marks and other identifiers of the World FunDrinks Award is governed by the applicable trademark and licensing provisions.
7.4 Awards may only be used for the product actually submitted and evaluated and only within the scope of the rights of use granted for that purpose.
8. Publication and Communication
8.1 The participant agrees that company and product information provided in connection with participation may be used for the organisation, documentation, publication and communication of the World FunDrinks Award.
8.2 This may include, in particular:
Company name, producer, brand, product name, product category, product description, images, logos, evaluation results, scores, medals, awards, titles and classifications.
8.3 Publication may take place, in particular, via websites, online guides, apps, press releases, newsletters, social media channels, videos, print media and other communication platforms of the organiser.
8.4 The participant confirms that they hold the necessary rights to the texts, images, product images, trademarks and logos provided.
8.5 The participant shall indemnify the organiser against justified third-party claims arising from an infringement of copyright, trademark rights, personality rights or other rights for which the participant is responsible.
9. Changes, Postponement or Cancellation
9.1 The organiser reserves the right to change dates, procedures, categories and organisational details of the World FunDrinks Award for objectively justified reasons.
9.2 In the event of force majeure or other circumstances beyond the organiser's reasonable control, the competition may be postponed, modified in its implementation or cancelled.
9.3 Participants who have already registered will be informed of significant changes as soon as reasonably possible.
9.4 In the event of complete cancellation of the competition, participation fees already paid will be handled in accordance with the applicable legal provisions and taking into account services already provided.
10. Liability
10.1 The organiser shall be liable in accordance with the applicable statutory provisions for damage caused intentionally or through gross negligence.
10.2 In cases of slight negligence, the organiser shall only be liable for breaches of essential contractual obligations and to the extent permitted by law.
10.3 The organiser accepts no liability for loss, damage, breakage or changes in the quality of product samples during shipment to the organiser, unless such circumstances are attributable to the organiser.
10.4 The organiser does not guarantee that an award or classification will result in any particular economic, promotional or commercial success for the participant.
11. Data Protection
11.1 Personal data is processed in accordance with the applicable data protection regulations.
11.2 Data is processed in particular for the purposes of registration, communication, invoicing, conducting the competition and publishing competition results.
11.3 Further information regarding the nature, scope, legal basis and purpose of the processing of personal data can be found in the current World FunDrinks Privacy Policy.
12. Applicable Law
12.1 All legal relationships between the organiser and the participant shall be governed by the laws of the Republic of Austria, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), unless mandatory statutory provisions provide otherwise.
12.2 In relation to consumers, this choice of law shall apply only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
13. Alternative Dispute Resolution
The organiser is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body unless required by law.
14. Final Provisions
14.1 In addition to these GTC, the current World FunDrinks Award Rules & Regulations and the applicable trademark and licensing provisions shall apply.
14.2 In the event of any conflict between these GTC and the Rules & Regulations, these GTC shall take precedence with regard to the contractual relationship. The Rules & Regulations shall govern the professional conduct of the competition, evaluation and granting of awards.
14.3 Should individual provisions of these GTC be or become wholly or partially invalid or unenforceable, the remaining provisions shall remain unaffected to the extent permitted by law.
14.4 The version of these GTC valid at the time of the respective registration or booking shall apply.
